• Personal Information. In order to purchase VELOCITY Products or Services, you will be required to provide personal contact information (your name, address, telephone number and email address) as well as credit card information for payment purposes. Your personal information will be used only in strict accordance with the VELOCITY Box Office Privacy Policy. Your credit card information will be used only to process your payment, manage your account, and resolve any related disputes in connection with your purchase, and in strict accordance with the VELOCITY Box Office Privacy Policy.
• Prices. Prices for all VELOCITY In Higher Definition concerts and VELOCITY Broadcast events, and other Products and Services available for purchase on this Web Site, will be displayed on the applicable web page before you place any order. If any taxes, shipping or handling charges apply, these will be displayed as well before you register for an event or place an order. Prices indicated at the time of registration or order will apply to that registration or order; however, VELOCITY and Affiliates reserve the right to change prices at any time, provided that such changes shall only apply to your future purchases.
• Payment. You authorize VELOCITY and its Affiliates to charge to your credit card account the prices, taxes, shipping and handling charges applicable to your purchase of any Product or Services that you purchase via this Web Site, including Access Passes, Tickets, or eTickets for VELOCITY In Higher Definition concerts and VELOCITY Broadcast events, and other Products and Services made available from time to time.
• Availability. VELOCITY will use commercially reasonable efforts to confirm your purchase of any Access Passes, Tickets, or eTickets for a VELOCITY In Higher Definition concert or VELOCITY Broadcast event, or of any other Product or Service, via e-mail confirmation and/or issuance via e-mail of VELOCITY Access Passes, Tickets, or eTickets within one business day of such receipt, and to keep you informed of event schedules, and Product and Services availability and stock status. If event registration closes for any reason after you have placed an Access Passes, Tickets, or eTickets order, a Product is out of stock, or a Service no longer available, VELOCITY will use commercially reasonable efforts to notify you via e-mail within 48 hours. If we are unable to ship ordered Products to you within 30 days, we will notify you and you may cancel the order. While VELOCITY makes reasonable efforts to provide the Products and Services offered via this Web Site and shall use reasonable efforts in the performance of any such Services, VELOCITY cannot and does not guarantee the availability of any events, services, or products.
• Access Pass, Ticket, and eTicket Transfers and Refunds. Registrations and Access Passes, Tickets, or eTickets that you purchase via this Web Site are non-cancelable and non-refundable, except as expressly stated in this Purchase Policy. In the event that an eTicket is issued, you may transfer your eTicket to someone else by visiting our eTicket Transfer page on this Web Site and registering the transfer of your eTicket. If a concert or event is rescheduled for another date, we will notify you at the same email address you provided to us when making your eTicket purchase. If a concert or event is cancelled and not rescheduled, we will notify you and provide you with an opportunity to exchange your Access Passes, Tickets, or eTickets for another In Higher Definition concert or VELOCITY Broadcast event. If you do not exchange your Access Passes, Tickets, or eTickets within thirty (30) days of our cancellation notice to you, we will process a credit to your credit card account for the charges associated with your Access Passes, Tickets, or eTickets purchase.
• Product Returns. You may return any unopened (in its original packaging) and undamaged Product for full refund within thirty (30) days of shipment. VELOCITY will have no obligation to provide a refund for Products that are opened, or returned more than thirty (30) days after delivery. VELOCITY will use commercially reasonable efforts to process all refunds within ten (10) days of your completing a refund claim with Customer Service. Severability. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be enforced to the maximum extent permissible so as to effect the intent of this Agreement, and the remainder of this Agreement shall continue in full force and effect.

Choice of Law. This Agreement shall be governed by and interpreted in accordance with laws of the Commonwealth of Pennsylvania, without giving effect to any conflict of laws provisions. The parties hereby consent to the exclusive jurisdiction of and agree that venue is proper and convenient in the state and federal courts situated in the Commonwealth of Pennsylvania.

Waiver. The failure of VELOCITY to exercise or enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.

Survival. The provisions of this Agreement which by their nature would continue beyond termination or expiration of this Agreement shall survive termination or expiration.
